Terms and Conditions

Section 1: General

Promotion name: Courier Merchandise Survey

Promoter: The Promoter is Menulog Pty. Ltd. ABN 76 120 943 615 of Level 35, Tower 3/300 Barangaroo Ave, Barangaroo, Sydney, NSW, 2000

Promotional Period: The Promotion starts at 12.00pm AEST on 10 August 2022 and closes at 11.59am AEST on 15 August 2022.

Section 2: Eligibility

Entry Restrictions: Entry is open to residents of Australia who are aged 18 years or over. The Entrant must not be an employee, manager, director of the Promoter, their related companies and agencies, and their immediate families.

Eligible Entrant: An Eligible Entrant is a courier on the Menulog network that completes the Courier Merchandise Survey.

Section 3: Entry to the Promotion

Entry Method: To enter, Eligible Entrants must complete the Courier Merchandise Survey during the Promotional Period.

Maximum entries: Multiple entries are not permitted. An Eligible Entrant's first entry is considered their entry for the Promotion.

Section 4: Selection of winners

Eligible Entrants who have fulfilled the conditions specified in section 3 can win one of the prizes as set out in section 5. 

Five winners are chosen based on the most inventive ideas for improvements to the Menulog merchandise.

All decisions are at the discretion of the Promoter and no correspondence will be entered into. The Promoter reserves the right to reject any entries that do not enter into the spirit of the competition or entries which otherwise do not comply with these terms and conditions, at its sole discretion.

The Eligible Entrants consent to the Promoter, its related companies and the competition sponsors using comments made on the competition page, including placing such comments on its websites or third party websites for any commercial purpose including future promotional marketing and publicity purposes. Unless expressly requested by the Eligible Entrants to do so, we may not acknowledge your authorship when posting comments.

Conditions of prize: The Prize is subject to the following conditions:

  • Terms of Use: By accepting the Prize, Entrants agree to the Menulog Terms of Use: https://www.menulog.com.au/info/privacy-policy-and-terms-of-use.
  • No exchange of Prize: The Prize will be supplied as described in these Terms and Conditions. The Prize can be transferred to another person or entity with approval of the Promoter. However, it cannot be exchanged or redeemed for cash. If for any reason, the Prize Winner cannot take any component of the Prize and it does not wish to transfer the Prize, then the Prize will be forfeited.
  • Taxes: Winners will be responsible for any tax liability associated with a Prize.
  • If a prize or element of a prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu.

Section 6: Prize Winners

 Prize Winner Notification: Prize Winners will be notified by email by 5pm AEST on 16 August 2022.

 Prize Claim Date: The Prize Winner must claim their prize by responding to the email by 5pm AEST on 19 August 2022. If the prize is not claimed by the Prize Claim Date, the prize will be forfeited and the Promoter may determine an alternative winner.

 Re-Judging, Prize Winner Notification and Publication Details: In the event that the prize is not claimed by the Prize Claim date, or an entry is deemed invalid, or otherwise forfeited, the Promoter will select a prize winner again as per section 4 at 12pm AEST on 22 August 2022. The winner will be notified by email on the same date.

Winner Publicity: In accepting a Prize, the Prize Winner agrees to participate in any publicity arrangements made by or on the behalf of the Promoter in relation to the Promotion. The Prize Winner further acknowledges that the Promoter reserves the right to publicise their name, state, country and photographs without any payment being made to them in respect of this Promotion.

The Prize Winner will be responsible for ensuring they are able to accept the Prize as set out, including any expenses and arrangements involved in collecting and using the Prize, and in accordance with these terms and conditions. Prizes, or components of Prizes, are subject to availability and the Promoter reserves the right to substitute any Prize, or component of a Prize, with a Prize of equal or greater RRP value, subject to any written directions from a relevant regulatory authority. Winners will not be entitled to any additional compensation in the event that the Prize (or component thereof) has been substituted at equal or greater RRP value.

Section 7: General Conditions 

Lost, Delayed Communication: The Promoter will not be responsible for any delayed, lost or misdirected mail or any other communication. 

Release: To the fullest extent permissible by law, each Entrant in the Promotion including without limitation the Prize Winners, releases the Promoter from any claim, loss, damage, expense (including any claim for legal expenses), cost or charge sustained or in any way incurred by such Entrant in connection with the Prize or their participation in the Promotion. The Promoter, its related bodies corporate, their officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect, consequential and economic loss) suffered or sustained in connection with this Promotion, the promotion of this Promotion, or the use of any Prize, except for any liability which cannot be excluded by law. Further, to the fullest extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any website, or any unauthorised intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to participants' or any other person's computer related to or resulting from participation in or downloading any materials in this Promotion. The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.

Force Majeure: Subject to applicable law, the Promoter will not be responsible for any act, omission, failure or delay by the Promoter that is due to an act of God, riots, acts of terrorism, storms, fire, any labour or industrial dispute, any strike, and other acts, including but not limited to COVID restrictions, which are not reasonably within the control of the Promoter.

Disputes: These terms and conditions and any dispute or claim (including a non-contractual dispute or claim) arising out of or in connection with these terms and conditions shall be governed by the laws of New South Wales and subject to the non-exclusive jurisdiction of the courts of that State.

Privacy Notice: During the course of the Promotion, the Promoter may collect personal information in relation to Entrants and their representatives. This may include, but is not limited to, the names, email addresses, telephone numbers and other details provided by the Entrant on the registration form. The Entrant's and its representative’s personal information is collected so the Promoter is able to contact and award the Prize to the Prize Winner, to publish the results of the Promotion and to publicise the Promotion. If an Entrant would like any further information about the Promoter’s privacy notice or practices, please contact the Promoter at privacy@menulog.com.

Consent to use of Personal Information for Marketing Purposes: Furthermore, by entering this Promotion, unless otherwise advised by the Entrant or its representative, each Entrant and its representative consents to the retention and use of the information collected by the Promoter, which trades as Menulog. Each Entrant acknowledges that the Promoter may use and disclose their personal information to offer the Entrant products and services that the Promoter believes may interest the Entrant. The Promoter may also disclose the Entrants’ personal information to the Promoter’s related companies or to other trusted business partners so that they can tell the Entrants about their products and services, and to other companies who assist the promoter to market its product and service. If an entrant does not want to receive marketing offers by email or in hard copy, the Entrant can contact the Promoter at privacy@menulog.com. For more details about who we are, how we may use your information and what your rights are under the privacy laws, please see our privacy policy, which is available from the Promoter at www.menulog.com.au. Uses may include future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the Entrant or its representative, or distribution of marketing materials for goods or services in the food, technology and ecommerce industries from the Menulog Group.

Use of content: By submitting an entry, each Entrant grants the Promoter a worldwide, non-exclusive, royalty-free licence (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such entry or any adaptation thereof (or any part of any such entry or of any such adaptation), in any and all media or distribution methods whether now known or later developed, without any restrictions and without any payment to the entrant or other consideration of any kind. Each Entrant irrevocably and unconditionally consents, as the author, to the fullest extent permitted by law (either present or future), to the Promoter (and its licensees, contractors, assignees and successors and their licensees, and any other person authorised by any of them):

  • using, disclosing, reproducing, copying, adapting, publishing, performing, exhibiting, communicating or transmitting any entry that the entrant submits as part of the competition or any adaptation thereof (or any part of any such entry or of any such adaptation), anywhere in the world, in whatever form and in whatever circumstances the Promoter (or its licensees, contractors, assignees and successors and their licensees, and any other person authorised by any of them) think fit, including the making of any distortions, additions or alterations to, or mutilating or destroying, any entry or any adaptation thereof (or any part of any such entry or of any such adaptation) as so used, disclosed, reproduced, copied, adapted, published, performed, exhibited, communicated or transmitted; and
  • using, disclosing, reproducing, copying, adapting, publishing, performing, exhibiting, communicating or transmitting any entry that the entrant submits as part of the competition or any adaptation thereof (or any part of any such entry or of any such adaptation) anywhere in the world without making any identification of the entrant as the author in relation to any of them.
